Call for Comment - Draft Block Exemption for the Promotion of Exports, 2025

The draft Block Exemption for the Promotion of Exports, 2025 (Regulations) , published by the Department of Trade, Industry and Competition (the dtic) for public comment.

As highlighted, the regulations seek to support South African exports and mitigate the impact of rising tariffs by exempting certain agreements from specific provisions of the Competition Act 89 of 1998. Exempt categories include:

  1. Coordination for economies of scale
  2. Cost-sharing and joint infrastructure development
  3. Collective marketing efforts in export markets

Please note that prohibited practices such as market allocation and collusive tendering remain excluded.
