BUSA Update (For information): Insourcing Bill B19 of 2025

The Portfolio Committee on the Insourcing Bill, a Private Member's Bill introduced by Ms Maotwe, MP, seeks to address the adverse impacts of outsourcing and the over-reliance on private contractors. The Bill outlines its objectives for both the short and long term, emphasising its integral role within the broader reform agenda for public service and administration. The Bill's provisions include the responsibilities of organs of state and the implications for existing accountability and reporting channels. The Bill aims at phasing out active contracts for services targeted for insourcing. Additionally, introduce the exemptions permitted by the Bill. Several provisions have been published under the Insourcing Bill B19 of 2025, which include:

  • The requirement for organs of state to insource regularly required services, including security, cleaning, gardening, maintenance, catering, auditing, transport, IT, administration, healthcare, and any other prescribed services.
  • The development and implementation of an insourcing policy by the Minister, promoting job security, fair labour practices, skills development, and ethical administration.
  • Obligations for organs of state to implement insourcing, including proper personnel deployment, monitoring mechanisms, and employee training when services must be temporarily outsourced.
  • Exemptions, reporting, and transitional provisions, including the continuation of existing outsourced contracts, progress reporting to Parliament, and the Minister's authority to prescribe additional services or issue guidance to achieve the Bill's objectives.
